About the Summer Program

As global efforts to address non-communicable diseases (NCDs) are accelerating, complexity is increasing and the importance of law is becoming more apparent. Understanding the powers, duties and constraints created by law is now essential not only for lawyers, but also for officials and advocates working on NCDs.

The O’Neill Institute Summer Program on NCDs and the Law will take a global approach to the issues, while also drawing upon case studies from domestic law. Participants will enhance their understanding of the global burden of NCDs, contemporary developments at the international level, international instruments governing NCDs, best practice regulation, the intersection of human rights and NCDs and the intersection of trade, investment and NCDs.

International Human Rights Treaties and Tobacco Control

Significant advances have been made, and continue to be made, in international tobacco control. However, more policy attention still needs to be paid to the link that exists between tobacco consumption and poverty. The burden of the tobacco epidemic is not fairly distributed: while overall tobacco consumption is decreasing in the developed world, it continues to increase in developing countries. The disparity in consumption exists not only between countries, but also within countries. In developed countries, consumption is higher among lower income families.Although the reasons behind this trend are not fully known, tobacco consumption has a significant impact on the lives and economies of lower income families in developing and developed countries. As such, tobacco control policies need to fully recognize the links between tobacco and poverty.

At first glance, why wouldn’t society want to allow prisoners to voluntarily donate organs? It seems like it is a win-win: the prisoner can exercise his or her choice (some would say “right”) to save a life, while society wins by reducing the scarcity of life-saving organs. But what seems like a win-win is unethical and unbefitting a democracy.

Why most airlines charge your extra-luggage but they do not charge your extra-weight? At a time of high fuel costs and experimental lifestyle regulatory action, economists, business analysts and airline operators begin to play with the idea of ‘pay as you weigh’ pricing.

Introduction

If weight is the key concern for an airplane operation, why do most airlines charge you extra-luggage but they do not charge your extra-weight? At a time of high fuel costs and experimental lifestyle regulatory action, economists, business analysts and airline operators begin to play with the idea (and many others).

Although it initially sounded as an April Fool’s Day joke, Samoa Air announced on April 1 that it is ready to initiate a plan to charge passengers according to their body weight. This tiny company is thus set to become the first airline in the world to embrace a ‘pay-as-you-weigh’ pricing policy and charge passengers based on weight rather than per seat.

There’s been talk of charging by this method for a while and some analysts believe this is how we’ll all be paying for future flights. No surprise the provocative CEO of Ryanair, Michael O’Leary, has been flirting with the idea to impose an extra levy on passengers who weigh considerably more than average.

Health Warnings on Junk Food

Chile is set to become the first country in the world to introduce mandatory health warnings on food products. It remains to be seen how this labeling scheme will score under WTO law and in particular the necessity test imposed by the TBT Agreement.

The international community learned last week, on the occasion of the latest meeting of the TBT Committee, Chile’s proposed amendments to its Food Health Regulations — which would place “STOP” signs on junk food.

New York’s Ban on Large Sodas: Just What Common Sense Requires

A state trial judge on Monday blocked New York City’s plan for a maximum 16 oz. size for a high-sugar beverage. The ban would have included sodas, energy drinks, fruit drinks and sweetened teas. But it would have excluded alcoholic beverages and drinks that are more than 50% milk, such as lattes. The ban would have applied to restaurants, movie theaters, stadiums and mobile food carts. But it would not have applied to supermarkets and convenience stores, such as 7-Eleven.

Mayor Bloomberg’s proposal was met with fierce opposition by the industry and public outrage at the loss of “liberty”—the so-called “nanny state” run amok. Beyond all the hype, the industry’s vociferous arguments, now adopted by a trial court, are badly flawed.

In fact, the Board of Health has the power, indeed the responsibility, to regulate sugary drinks for the sake of city residents, particularly the poor.

The O’Neill Institute Colloquium, offered annually, is an interdisciplinary course that draws from the work of scholars, policymakers, and the general health community. The course is taught and moderated by Institute-affiliated faculty, and the goal of the Colloquium is to engage leading thinkers and students in an enriching dialogue regarding critical health law issues. National and international scholars, practitioners and policymakers explore contemporary health issues with top students interested in health law and related issues from schools throughout the University. The Colloquium sessions are open to University faculty members and interested members of the public.
